Terms and Conditions FairLoop

Effective date: 23 November 2025

These terms and conditions apply to the use of FairLoop, the digital marketplace platform for the fairground and amusement sector. By using FairLoop, the user agrees to these terms and conditions.

1. Definitions

In these terms and conditions, the following definitions apply:

FairLoop
The online marketplace platform managed by MB Kermis.

MB Kermis
The administrator of the FairLoop platform, located in Oss, the Netherlands.

User
Any individual or organisation that creates an account and uses the platform.

Provider
A user who places a listing.

Buyer
A user who completes a purchase through the platform.

Listing
An advertisement in which an object, service or offer is presented.

Object
Any item or service offered through a listing, including rides, parts, trailers, materials, decoration, plush items, ingredients and other industry related products.

Service
All functionalities and services of FairLoop, including search, placing listings, transaction support and communication between users.

2. Applicability of the terms

These terms and conditions apply to all users of FairLoop.

When a user creates an account or uses the platform, this is considered acceptance of these terms and conditions.

MB Kermis reserves the right to amend these terms and conditions when necessary. The most current version is always available on the platform.

3. Purpose of FairLoop

FairLoop provides a digital platform where users can offer and obtain objects and services. The platform is focused on the fairground and amusement sector, both nationally and internationally.

FairLoop functions solely as an intermediary platform. MB Kermis is not a party to agreements between users and does not interfere with the content or execution of transactions.

4. Account and use of the platform

Users must be at least eighteen years of age.

Information provided during registration must be accurate and up to date.

The account is personal and may not be shared with others.

Misuse of the platform, fraud, deception or violation of applicable law may result in termination or restriction of the account.

5. Listings and responsibilities of providers

Providers are fully responsible for the content of their listings. This includes, among other things:

  • a clear description of the object
  • correct pricing
  • current availability
  • accurate photographs
  • description of the condition, including any blemishes
  • information about inspection documents or certifications, where applicable

Listings that are misleading, incorrect or unsuitable may be refused or removed.

6. Payments and costs

FairLoop uses Stripe for online payments when this functionality is available.

Any service fees are clearly displayed in advance before a payment is made or a listing is placed.

Users are responsible for their own tax obligations.

7. Agreements between users

When a transaction is concluded through FairLoop, the agreement is formed exclusively between the involved users.

They arrange among themselves, including but not limited to:

  • delivery or collection
  • shipping
  • transport
  • installation or assembly
  • insurance
  • payment outside Stripe, if agreed
  • return arrangements, where applicable

The transfer of risk takes place once the buyer physically receives the object.

8. Industry specific obligations

Users must comply with applicable safety regulations, such as inspections and certifications.

Additional requirements may apply in the Netherlands, Belgium and Germany.

Providers are required to comply with all applicable laws and regulations.

MB Kermis is not liable for deficiencies or unsafe situations arising from users or from objects offered through the platform.

9. Liability

MB Kermis strives to provide a properly functioning and secure platform but cannot guarantee full availability.

MB Kermis is not liable for:

  • damage caused by users
  • incorrect or misleading listings
  • incorrect transactions
  • damage to or caused by objects offered through FairLoop

The liability of MB Kermis is limited to the extent permitted by law.

10. Intellectual property

All rights relating to FairLoop, including the design, software and structure of the platform, belong to MB Kermis or its licensors.

Users may not copy or distribute texts, images or systems from the platform without prior permission.

11. Account termination

Users may terminate their account at any time via info@fairloop.nl.

MB Kermis may terminate or restrict an account if rules are violated or misuse is identified.

12. Governing law

These terms and conditions are governed by Dutch law.

Disputes shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
